Is A Divorce Made During The Menstruation Period Of The Wife Valid?

Is a divorce made during the menstruation period of the wife valid?

Although it is against sunnah, the four madhhabs are of the opinion that a divorce made during the menstruation period of the woman is valid (Sarakhsi, al-Mabsut, VI, 16; Ibn Qudamah, X, 327; Ibn Rushd, Bidayat al-Mujtahid, II, 64). On the other hand, some religious scholars claim that a divorce made during the menstruation period is invalid since the divorce procedure should be performed in compliance with the conditions stipulated by religion, and the fact that the divorce should be done in the cleanliness period is one of such conditions (Ibn Taymiyyah, Majmu’ al-Fatawa, XXXIII, 81 ff.). The fatwa in this matter is given according to the opinion of the majority.
